1. Definitions

For clarity and comprehension, we have defined certain words used in the Terms and on the website/Apps. Additional definitions are included elsewhere in the Terms.

Member Firm : means a local partnership, firm or other entity that is a member of the 24eFiling network of firms, each of which is a separate legal entity, as well as any affiliate or subsidiary of any Member Firm.

Partner & Principal : mean an individual who is a partner, principal, member, shareholder or equivalent of a Member Firm, in accordance with terminology commonly used in professional services organisations.

Likewise “office” refers to any office of one or more Member Firms in the relevant jurisdiction.

24eFiling , we or us : refer to the 24eFiling network and/or its individual Member Firms. 24eFiling, we or us, as used in individual articles and thought leadership pieces available on the website/Apps may, depending on context, refer to the 24eFiling network as a collective or to individual Member Firms.

24eFiling Parties : refers collectively and inclusively to the individual Member Firms of the 24eFiling network, including their respective officers, directors, partners, principals or equivalent; personnel; affiliates; business associates; licensors; and contractors and subcontractors.

Registered User : means a User who has registered and created an Account with 24eFiling to access enhanced features of a website/App/App.

User : means all users of a website/App.

you : means you as an individual user of a website/App/App.

2. Ownership

This Site is owned and operated by 24eFiling. All right, title and interest in and to the materials provided on this Site, including but not limited to information, documents, logos, graphics, sounds and images (the “Materials”) are owned by 24eFiling. Except as otherwise expressly provided by 24eFiling, none of the materials may be copied, reproduced, republished, downloaded, uploaded, posted, displayed, transmitted or distributed in any way and nothing on this Site shall be construed to confer any licence under any of 24eFiling’s intellectual property rights, whether by estoppel, implication or otherwise. Any rights not expressly granted herein are reserved by 24eFiling.

We may add other features from time to time. Certain features are available only to Registered Users. Neither the website/Apps nor the content available within them constitutes professional advice, and neither should be relied upon by you or any third party, including for example to obtain any regulatory or governmental approvals, or otherwise to procure services or other benefits from any entity. 5. Changes to and availability of the website/Apps

The website/Apps/Apps are made available on an “as is” basis with no representation or warranty with respect to their functionality or availability and with no guarantee that they are complete, accurate, or timely nor any guarantee regarding any results you or others may obtain from their use. Access to all or parts of any of the website/Apps/Apps may be suspended at any time without notice.

6. Eligibility

You may use the Site only if you can form a binding contract with 24eFiling, and only in compliance with these Terms and all applicable laws, rules and regulations. Any use or access to the Site by anyone under 18 years of age is strictly prohibited and in violation of these terms. The Site is not available to or authorised for use by any users previously removed from the Site by 24eFiling, any users or persons acting on behalf of an organisation or entity and not in his or her personal or individual capacity, or any users accessing the Site for any purpose other than to seek to participate in an actual ride for personal purposes, unless specifically authorised by 24eFiling (collectively “Unauthorised Users”). Unauthorised Users are strictly prohibited from accessing or attempting to access, directly or indirectly, the website/App. Any such unauthorised use is strictly forbidden and shall constitute a violation of applicable laws.

7. Monitoring

We may monitor use of the website/Apps from time to time but have no obligation to do so. If and when we do monitor your use of one or more of the website/Apps, we will do so in accordance with applicable law.

8. Your responsibilities

You will use the website/Apps only for lawful purposes. If at any time you become aware of any violation, by any person or entity, of any part of these Terms, you will immediately notify us and provide us with assistance, as requested, to stop or remedy such violation.

In using the website/Apps, you must not do any of the following:

Post, transmit, or otherwise make available through the website/Apps any material protected by copyright, trademark, trade secret, right of publicity or privacy or any other proprietary right, without the express prior written consent of the applicable owner.

Use the website/Apps for any commercial purpose or otherwise use the website/Apps for processing data or other information on behalf of any third party.

Use the website/Apps for any purpose that is fraudulent or otherwise tortious or unlawful.

Interfere with or disrupt the operation of the website/Apps or the servers or networks used to make the website/Apps available, including by hacking or defacing any portion of any of the website/Apps; or violate any requirement, procedure or policy of such servers or networks.

Restrict or inhibit any other person from using the website/Apps.

Create or share content without first obtaining any necessary permissions from third parties or otherwise use the website/Apps to post or transmit any information that you do not have the right to provide; that would violate any applicable law or regulation; or that would violate, infringe or misappropriate any third party right or interest.

Reproduce, modify, adapt, translate, create derivative works of, sell, rent, lease, loan, timeshare, distribute or otherwise exploit any portion of (or any use of) the website/Apps except as expressly authorised herein, without 24eFiling’s express prior written consent.

Reverse engineer, decompile or disassemble any portion of any of the website/Apps, except where such restriction is expressly prohibited by applicable law.

Remove or alter any copyright, trademark or other proprietary rights notice on the website/Apps or content you access via the website/Apps.

Frame or mirror any portion of the website/Apps, or otherwise incorporate any portion of the website/Apps into any product or service, without 24eFiling’s express prior written consent.

Systematically download and store website/Apps’ content.

Use any robot, spider, website/Apps search/retrieval application or other manual or automatic device to (a) retrieve, index, “scrape,” “data mine” or otherwise gather content from the website/Apps, (b) reproduce or circumvent the navigational structure or presentation of the website/Apps, or
(c) Harvest or collect information about users of the website/Apps without 24eFiling’s express prior written consent.

If you do not comply with these Terms (or if we have reasonable grounds to suspect or are investigating suspected non-compliance), we may suspend your access to the website/Apps/Apps or take any other steps we consider appropriate.

9. Requirements to Use the website/Apps

If you are using the website/Apps on behalf of a corporation or other organisation, you represent and warrant that you have the ability to agree to these Terms on behalf of such organisation and all references to “you” throughout these Terms will include such organisation, jointly and severally with you personally.

10. Registration

Certain features of the website/Apps are available only to Registered Users. Current examples include access to premium content, reading lists, and any on-site commenting or collaboration activities. Additional features may be made available to Registered Users over time.

To register, you will need to provide certain information about yourself and create a username and password. This combination of information (“Account”) will be your Account as a Registered User.

Registrations may be accepted, rejected or cancelled by us at any time and for any reason. If your registration is cancelled, you will continue to have access to the website/Apps/Apps; however, you will no longer have access to features available only to Registered Users.

11. Responsibilities of Registered Users

If you choose to register with us and become a Registered User, you agree you are solely responsible for your Account and any and all activities that occur under your Account, including all activities of any persons who gain access to your Account with or without your permission.

In becoming a Registered User, you also agree to:

maintain the confidentiality and security of your Account, including your username and password;

notify us immediately of any unauthorised use of your Account, Account password, or service provided through your Account, as well as any breach of security with respect to your Account, Account password, or service provided through it; and

assist us, if and as we request, to stop or remedy any breach of security related to your Account.

12. Privacy of Registered Users

Our Privacy statement explains how we protect and use your information; the Registered User section of the Privacy statement explains additional information we collect and additional uses of information about Registered Users.

13. Termination

We may, in our sole discretion, suspend, restrict or terminate your use of the website/Apps (including your Account, if you are a Registered User), effective at any time, without notice to you, for any reason, including because the operation or efficiency of the website/Apps or our or any third party’s equipment or network is impaired by your use of the website/Apps; we have received a third party complaint which relates to your use or misuse of the website/Apps; or you have been or are in breach of any term or condition of these Terms. We will have no responsibility to notify any third party, including any third party providers of services, merchandise or information, of any suspension, restriction or termination of your access to the website/Apps.

14. Cancellation and Refund Policy

We strive to ensure that the services you avail through our website/App are to your full satisfaction, and are the best in the Industry at extremely reasonable and affordable rates.

However, there may arise situations when you desire a refund. Firstly, when you pay for the services but later on decide that you do not wish to avail them. Secondly, when there is a delay in the services offered from our side, beyond the time frame we have intimated to you, due to human error i.e., factors for which we are solely responsible. Thirdly, although we highly doubt it, you might find our services unsatisfactory. In all three situations, kindly send in an e-mail to on the Ticket/Ref. No. that has been created in your name, marking a copy to info@24eFiling.com. We would like to clarify that only refunds of the professional fees component of the charges paid by you shall be considered for a refund.
Upon receiving your mail, the Senior Management at 24eFiling shall decide on whether your request for a refund should be processed, contingent on the reasons for such a request. Please note that we reserve the right to take the final and binding decision with regard to requests for refund.

Most importantly, we wish to clarify that in cases outside our control, including but not limited to national holidays, department holidays, delays on the part of the Government of India, the respective State Governments, Our affiliates or elsewhere, acts of war, acts of God, earthquake, riot, sabotage, labour shortage or dispute, internet interruption, power disruption, lack of phone network connectivity, technical failures, breakage of sea cable, hacking, piracy, we shall not liable for any delays.

If we confirm your request for refund, subject to the terms and conditions mentioned herein or elsewhere, we will send you an e-mail seeking the details required to refund the amount which may include your Bank Account details such as the account number and the IFS code of the branch in question. Kindly note that it will take us a minimum of about 48-72 working hours from the receipt of all such information to process the refund and initate the transfer.

We reiterate once again that only the professional fees paid for our services shall be refunded, subject to the discretion of the Senior Management at 24eFiling.com.

15. Intellectual Property

Except where expressly stated otherwise, all right, title, and interest in and to the website/Apps and all Content, source code, processes, designs, technologies, URLs, domain names, marks, and logos forming any part of the website/Apps (collectively, “Our Content”) are (a) fully vested in us, our licensors, or our suppliers and (b) protected by applicable copyrights, trademarks, patents, trade secrets, or other proprietary rights and laws.

You agree that access and use of Our Content is subject to these Terms, including the disclaimers and limitations of liability herein. Nothing in your use of the website/Apps or these Terms grants you any right, title or interest in or to Our Content except the limited right to use the website/Apps as set out in these Terms.

Unless otherwise expressly authorised by us in writing, you agree not to
copy, modify, deep link, rent, lease, loan, sell, assign, sublicense, grant a security interest in or otherwise transfer any right or interest in Our Content;
remove any proprietary notices or labels on or in Our Content; or
allows any other person or entity to engage in any of the foregoing.
You represent and warrant that you have all rights necessary to grant the licences referred to in these Terms. You further represent and warrant that your Submissions are (a) complete and accurate and (b) are not fraudulent, tortious, or otherwise in violation of any applicable law or any right of any third party. You irrevocably waive any “moral rights” or other rights with respect to attribution of authorship or integrity of materials regarding each Submission that you may have under any applicable law under any legal theory.

16. Complaint

If we receive a complaint relating to your use of the website/Apps, you acknowledge and agree that we may, in our sole and absolute discretion and without notice or liability, investigate the complaint, restrict, suspend or terminate any service involved, and/or remove your Submissions from our servers.

17. Third-Party Content

The website/Apps may contain links to website/Apps and other materials made available by third parties (collectively, “Third Party Content”). If you use such functionality, you are directing us to access, route and transmit to you the applicable Third Party Content.

We neither control nor endorse, nor are responsible for, any Third Party Content and we make no representations or warranties with respect to them. The availability of any Third Party Content through the website/Apps does not imply the endorsement of, or affiliation with, any provider of such website/Apps or materials. Your use of any Third Party Content is at your own risk and is subject to any terms, conditions and policies applicable to them (such as terms of service or privacy policies of the providers of the Third Party Content).

18. Confidentiality

24eFiling makes every effort to maintain the confidentiality of any information submitted by users to our system and our database of lawyers. The user is however warned that the use of the internet or e-mail for confidential or sensitive information is susceptible to risks that inevitably arise on this medium. Additionally, because 24eFiling cannot control the conduct of others, we cannot guarantee that this information will remain confidential. Please use caution in deciding what information to input into the System. Do not make any confessions or admissions. The user should preferably describe their issue or dispute in the general terms only. Specific information should only be revealed after the user has selected an advocate/lawyer/attorney and made contact outside the service (e.g. via telephone or appointment). Subscribing lawyers using this service should refrain from asking any user to reveal any specific or confidential information through the service. 24eFiling is not responsible for the release or improper use of such information by users or any release due to error or failure in the System.

19. Open Source

The website/Apps may include open source components, which are licensed for use and distribution by us under applicable open source licences. Use of these open source components is governed by and subject to the Terms and conditions of the applicable open source licence.

20. Warranties

24eFiling makes no representations or warranties about the site, which is provided “as is”. To the maximum extent permitted by law, we exclude all implied warranties regarding the site, including without limitation, the warranties of merchantability, fitness for purpose, title, and non-infringement.

21. Limitation of Liability

The website/Apps are provided for information purposes only and, to the maximum extent permitted by applicable law, 24eFiling and the 24eFiling Parties exclude all liability for any loss or damage of whatever kind and however arising in connection with your use of, or inability to use, the website/Apps and any materials you obtain via the website/Apps.

You acknowledge and accept that use of the website/Apps is subject to the risks inherent in any connection and transmission on the internet, in particular in relation to security risks and vulnerabilities, technical performance and risk of interruption. To the maximum extent permitted by applicable law, the 24efiling parties disclaim all liability and shall not be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation damages for lost profits or revenues, goodwill, work stoppage, security breaches, viruses, computer failure or malfunction, use, data or other intangible losses or commercial damages, even if any of such parties are advised of the possibility of such losses, arising under or in connection with these terms, the site, the use of or inability to use the same, or any other subject matter hereof.

The maximum extent permitted by applicable law, the 24efiling parties shall not be responsible or liable to you or any other person for any errors or omissions in the website/apps; any information made available through them; any decision made or action taken in reliance on the website/apps or the information made available through them; or for any loss or damages – including consequential, special or similar damages – that arise out of or in connection with your use of the website/apps or any information or materials obtained by you via or in connection with the website/apps.

22. Indemnification

To the maximum extent permitted by applicable law, you agree to defend (at the indemnified party’s option), indemnify, and hold the 24eFiling Parties and their insurers harmless from and against any action, proceedings, claims, causes of action, demand, debts, losses, damages, charges and costs, including reasonable legal costs and/or any amount paid to settle any action or to satisfy a judgement and expenses of any kind and character whatsoever incurred by us relating to or arising from any content or information posted or transmitted by you using the website/Apps or otherwise arising out of your use of the website/Apps or use of the website/Apps by any third party who is given or gains access to the website/Apps due to your action or inaction. Your indemnification obligation to the 24eFiling Parties includes but is not limited to any instance where one or more of your submissions (a) infringes any Third Party Content or other third-party intellectual property rights, or (b) is inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful.

The 24eFiling Parties have the right at any time to forgo the indemnification and assume the defence of any claim. Notwithstanding the foregoing, it is not the intent of the 24eFiling Parties to affect the rights of the 24eFiling Parties or their insurers to assume the defence or settlement of any claim against any 24eFiling Party for which insurance coverage is sought under any applicable insurance policy.

23. 24eFiling.com ONLY PROVIDES A MEDIUM FOR INTERACTION

24eFiling is an internet portal that facilitates communication between legal professionals and potential users of legal services. 24eFiling acts as a venue for providers and consumers of legal services to exchange information with the goal of eventually forming a professional relationship. 24eFiling does not guarantee that users will successfully find an advocate/lawyer/attorney through this system. 24eFiling takes no position and offers no opinion on when or if a lawyer-client relationship has been formed.

In order to provide an optimal forum for lawyers and clients, 24eFiling does not involve itself in the agreements between lawyers and clients or the actual representation of clients. Therefore, we cannot ensure the completion of the agreement or the integrity of either party. The user, and not 24eFiling, is solely responsible for assessing the integrity, honesty, and trustworthiness of all persons with whom the user communicates on this service.

24. Disclaimer of lawyer-client relationship

24eFiling is not an agent of lawyers. It only facilitates the communication of lawyers and potential clients. Any electronic communication sent to 24eFiling alone will not create a lawyer-client relationship between the user and 24eFiling, such being expressly denied.

24eFiling does not promote any User.

24eFiling seeks to help every needy litigant find lawyers best suited to his/her needs. 24eFiling is not intended to be a source of advertising or solicitation and the contents of the website/App should not be construed as legal advice. 24eFiling may recommend subscribing lawyers if they match a user’s requirements, but not otherwise. Transmission, receipt or use of 24eFiling does not constitute or create a lawyer-client relationship. No recipients of content from this website/App should act, or refrain from acting, based upon any or all of the contents of this site. We welcome the user to study the profiles of lawyers independently and make an informed choice.

26. Dispute Resolution and Arbitration Agreement

You and 24eFiling mutually agree to waive our respective rights to resolution of disputes in a court of law by a judge and agree to resolve any dispute by arbitration, as set forth below.

All disputes arising out of or in connection with the above, shall be referred to and finally be resolved by one or more arbitrators at Bangalore, Karnataka in accordance with the Indian Arbitration and Conciliation Act, 1996 as amended from time to time and the award made in pursuance thereof shall be binding on the parties.
You understand and agree that you and 24eFiling may each bring claims in arbitration against the other only in an individual capacity and not on a class, collective action, or representative basis (“class action waiver”). You understand and agree that you and 24eFiling both are waiving the right to pursue or have a dispute resolved as a plaintiff or class member in any purported class, collective or representative proceeding.

27. Assumptions of Risk

The website/Apps and all information provided to you via the website/Apps is provided “as is” and “as available.” To the maximum extent permitted by applicable law, the 24eFiling Parties disclaim all express, implied, and statutory warranties with respect to the same, including without limitation any implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, non-interference, error-free service, and uninterrupted service. 24eFiling neither represents nor warrants that the website/Apps, services and content provided through the website/Apps, or software or information downloaded from the website/Apps will be accurate, current, uninterrupted, error-free, omission-free, or free from viruses or other harmful components.

We reserve the right to amend these Terms at any time without notice to you, but we will use reasonable efforts to publish each amendment before such amendment becomes effective. The latest, fully-amended version of these Terms will be published on the website/Apps. You are responsible for regularly reviewing the website/Apps to obtain timely notice of such amendments. If any amendment is unacceptable to you, you may terminate the agreement between you and us regarding the use of the website/Apps as set out in these Terms. If you continue to use the website/Apps after the effective date of any amendment, you will be conclusively deemed to have accepted such amended versions of these Terms.

Any notice, consent, waiver, approval, authorisation or other communication to be delivered in connection with these Terms:

by us to you will be deemed to have been effectively and validly given if delivered or sent to any of the contact particulars then listed in your Account;

by you to us will be deemed to have been effectively and validly given only if in writing and delivered or submitted via this contact form

35. Entire Agreement

36. Severability

If a particular term is found to be unenforceable, this will not affect any other terms.
